Man charged with felony DUI after accident and high breath test

It is important that residents of South Carolina understand that no matter what the circumstances, facing charges for driving under the influence of alcohol is always a serious matter that should not be taken lightly. However, there are certain aspects of such charges that can increase the severity of these charges. One of those circumstances is a high breath test. Another is an accident that results in the severe bodily injury or death of another individual.

Take, for instance, a 26-year-old driver who is facing felony DUI charges after an accident that caused the death of a 21-year-old girl. At the time of the accident, the man's BAC level was allegedly more than two times the legal limit. South Carolina's legal limit is .08.

According to authorities and accident reports, the two individuals were traveling in a truck along with a second passenger. The three were on their way to a wedding when a pickup truck veered off the side of the road. When the pickup truck's driver attempted to correct his path, he overcorrected causing him to swerve and hit numerous trees in his path.

The collision threw the 21-year-old woman from the truck. She was pronounced dead at the scene of the accident. The driver and the other passenger survived but both had to be transported to a nearby hospital for treatment of their injuries.

The 26-year-old has been charged with felony DUI and, if convicted, could face a maximum of 25 years spent in prison and a $25,000 fine. In addition, South Carolina's implied consent laws allow the automatic revocation of the driver's license of a driver who is accused of driving with a high blood alcohol content. This revocation can last for up to 60 days.

Given the potentially severe nature of the consequences that are associated with a conviction, it is always important for the accused to protect themselves. The best way to do this often is to hire an experienced South Carolina DUI defense attorney who can take on these extra challenging cases and perform the careful research to obtain the most beneficial outcome possible for the accused.
