South Carolina woman with DUI record facing felony DUI charges

There are numerous dangers involved in operating a motorized vehicle on the roadways of South Carolina, as there are in any state. Sometimes these dangers manifest in the form of weather or road conditions and other times they manifest as behaviors exhibited by a driver operating their vehicle. If these behaviors involve driving while intoxicated and an accident results, the alleged drunk driver may face DUI charges.

Depending upon the severity of the accident and resulting injuries, if any, the charges may be qualified as a misdemeanor or felony DUI charges. A South Carolina woman is facing a felony DUI charge after her involvement in an accident that resulted in the death of a 22-year-old woman.

According to accident reports the woman was driving her GMC Yukon down the road when she struck the rear of a Kia Rio that was stopped at a red light. The impact caused the Kia to be pushed out into oncoming traffic where it was struck by a Toyota Camry.

The driver of the Kia was taken to a nearby medical center where she was unfortunately pronounced dead while in the emergency room.

The 36-year-old driver of the Yukon was charged with felony DUI after her BAC level registered at a 0.20. The legal limit for DUI charges in South Carolina is 0.08.

The charges that the woman is facing have serious penalties if she is convicted. These penalties, at a maximum, are a 25-year prison sentence and a monetary fine of $25,100.

Unfortunately, in this woman's case, she also has a prior driving-while-intoxicated conviction on her record. This could play into the court's decision in this case. Therefore, the potential for severe, life-altering consequences is heightened. The good news is that there are experienced drunk driving defense attorneys in South Carolina that are often able to help in these types of situations and negotiate less severe consequences for the defendant.
