Test accuracy is essential in driving under the influence cases

When a breath test shows that a driver has a blood-alcohol concentration higher than legally allowable, officers conducting a traffic stop will not hesitate to take action. From the perspective of law enforcement, having results from blood alcohol tests, from breath or blood draw, might make it seem as though a guilty verdict is inevitable.

However, this assumption made by law enforcement and prosecutors hinges on one thing: accuracy.

Without accurate test results measuring blood-alcohol concentration, it may not be safe to assume that a driver was over the legal limit.

This idea is particularly true for underage drivers. As we discussed in a blog post published on April 3 of this year, drivers under the age of 21 face a legal limit of 0.02 percent. This is much lower than the threshold for drivers of legal drinking age. Certainly, having accurate breath or blood test results is important in any DUI case, but the room for error is much smaller for instances involving drivers younger than 21.

As a result, individuals in this situation who are looking to launch a strong defense need to be thoughtful. In order to scrutinize the results of a blood or breath test, specific knowledge is necessary. Namely, working knowledge of the DataMaster DMT, the hardware used for breath tests in South Carolina, may be necessary.

With knowledge of exactly how this device words, it may be possible to pin point issues that may prevent the machine from producing accurate results. Our firm is well-versed with the DataMaster. Having a keen understanding of how to properly use the machine and flaws that may result in an inaccurate reading could make the difference in a case.
