South Carolina sheriff's deputy faces drunk driving charges

Last week in our Charleston DUI Law Blog, we wrote about the South Carolina Highway Patrol ordering all troopers to include detailed observations in all drunk driving arrest reports--including when the arrestee is a law enforcement officer. This week, South Carolina troopers had the opportunity to do just that.

According to The Post and Courier, A Spartanburg County, South Carolina, sheriff's deputy was charged with driving under the influence on Sunday. The man was reportedly involved in a one-car accident prior to the arrest. Details about the car accident were not provided in the news report.

The deputy is a regional commander on the uniform control division in Spartanburg County, according to the news report. He remained in the county jail Monday after being charged with DUI less than .10, an expired vehicle tag and open container of liquor in vehicle.

He has been suspended without pay from his law enforcement job until further notice, according to the county sheriff.

In South Carolina, the legal limit for blood alcohol content is .08. If a driver's BAC is measured between .08 and .10, and they are convicted of the charges, the penalties for a first offense may generally include a $400 fine or 48 hours to 30 days in jail, a temporary license suspension and the completion of an alcohol and drug safety action plan.

Of course, not everyone who is charged with DUI less than .10 is convicted. Oftentimes, the breath tests and other information in the arrest report are proven to be inaccurate by a criminal defense attorney.
