Head-on collision results in felony DUI charge for SC woman

It is likely that many residents of South Carolina have heard about the occurrence of a felony DUI charge or conviction in the news. However, it is a common misconception that felony DUI charges only result from fatal drunk driving accidents. In actuality, this is not always the case. In fact, this was not the case in a recent car accident that left a 22-year-old woman facing a felony DUI charge earlier this month.

The woman was driving eastbound, in the wrong lane, down a South Carolina highway just before midnight one evening when she struck a vehicle driven by a 20-year-old man. Both she and the driver of the other vehicle were taken to the hospital for treatment of their injuries. Doctors did not expect the driver of the other car to be alert nor conscious. However, he has defied those expectations and was hoping to be home from the hospital in time for Christmas.

As previously stated, a car accident can result in a felony DUI even if it does not cause death. Some of the situations, in addition to fatal injuries, that may lead to felony DUI charges include a head-on collision, video evidence of very poor field sobriety test performance, serious bodily injury to another person or a very high blood alcohol content level.

A typical DUI charge is considered a misdemeanor. However, when the circumstances escalate and the resulting charge is a felony DUI, it can mean severe consequences for the accused. In cases of felony DUI it is simply very important to have a rigorous defense.

This is because felony DUI cases are very serious, and often very complicated, meaning an in-depth investigation of the facts and evidence is necessary. This will generally include a review the details of the arrest and a study of the prosecutors' claim to determine if there are any holes or mistakes in their case.

These cases are not simple. With legal counsel, however, it can be possible to obtain an outcome that the defendant finds to be the most fair possible.
