Man facing felony DUI charges after single car accident

Each year, too many South Carolina residents get behind the wheel of their vehicle to drive after consuming too much alcohol. What they unfortunately may not realize, whether or not they are aware that they should not be operating a motorized vehicle, is that this decision can have very serious penalties.

Often times when an individual is convicted of driving while intoxicated it comes in the form of a misdemeanor. However, sometimes the ultimate result of driving while under the influence can be very severe. In these situations, the ultimate charges can be for felony DUI charges rather than a misdemeanor. A South Carolina man has recently found himself in this very situation.

The 26-year-old man was allegedly driving while intoxicated when he was involved in a car accident that resulted in the death of the passenger in his vehicle. According to authorities, the man was driving his truck when it ran off the road. When he tried to drive back onto the road he overcorrected which ultimately caused the vehicle to strike several trees. The 21-year-old female that was a passenger in his vehicle was pronounced dead at the scene of the accident.

A felony DUI charge can come with serious penalties. In this man's case, he could face a maximum of 25 years in prison and a fine of up to $25,000. These penalties would only be assessed if he is convicted of the felony DUI charge.

In a situation as dire as this one, the alleged drunk driver may feel very confused and scared. They also may not be sure of how to defend themselves to ensure that the outcome is not as severe as the potential maximum penalties in this case. The best option for defendants is usually to speak with an experienced drunk driving defense attorney. An attorney can protect the accused's rights and closely examine all of the state's evidence. In addition, an attorney can sometimes negotiate with the prosecution to obtain a lesser charge, which is usually accompanied by a lesser consequence for the defendant.
