Failed field sobriety tests are open to review

When it comes to impaired driving, South Carolina law enforcement officials will do all they can to remove these drivers from the road. Obviously, protecting overall public safety is a primary concern, but those who are accused of impaired driving deserve protection too. Field sobriety tests are typically used to determine if a person is impaired. Unfortunately, the results of these tests are not always accurate, and arrests may be made that are not really warranted.

There are three standard field sobriety tests that may be administered to drivers who are suspected of being impaired by drugs or alcohol. The horizontal gaze nystagmus test (HGN), the walk-and-turn and the one-leg stand. Each of these essentially tests a driver's ability to focus and balance. While these tests have proven to be sufficient in identifying impaired drivers, the results are subjective and open to interpretation.

According to South Carolina laws, officers are required to videotape the entirety of a DUI traffic stop. This includes the administration of the field sobriety tests. This step is important and allows for a review of the event. Charges for impaired driving may be difficult to fight, but it isn't a hopeless cause. Reviewing and questioning the results of field sobriety tests can help and may bring forth valuable information to benefit your case. An experienced criminal defense attorney who is familiar with South Carolina DUI laws can prove to be a valuable commodity as you fight these charges in court. By questioning any evidence offered against you and providing legal guidance, a defense attorney can help you make informed decisions and fight for the best possible outcome available for your specific situation.
