High blood alcohol tests do not always lead to conviction

When a police officer suspects someone of driving under the influence in South Carolina, the officer may request a blood test. If this test results in a high BAC (blood alcohol content) it can be a bit more difficult to challenge a DUI, but it does not mean it is impossible. In truth, a high BAC does not always lead to a DUI conviction.

There are many criteria that must be met before a conviction can take place. Working with an experienced attorney can make all the difference in whether a defendant is found guilty of DUI. For example, if the person who draws the sample for a blood alcohol test was not qualified to do so, then the results may be deemed invalid. A lawyer knows how to uncover this information and use it on the defendant's behalf.

Another way a blood alcohol test can be challenged is by examining the blood sample's chain of custody. Law enforcement is required to track the sample's movements and whereabouts at all times. If any gaps in the chain of custody are found, it can mean success for the defendant.

Finally, an attorney can challenge the equipment used to test the defendant's blood sample. In many cases, this equipment could be out of calibration resulting in inaccurate blood alcohol test results.

Unfortunately, many residents in the Charleston area do not understand the legal aspects of blood alcohol tests. As a result, some defendants may be convicted unfairly if no one challenges the results or the blood testing procedures.
