Repeat DUI charges: Conviction isn't a foregone conclusion

Dealing with drunk driving charges can feel overwhelming, which is something we've regularly addressed on this blog. However, those who are facing multiple convictions for driving under the influence of alcohol are up against a special kind of challenge. With each subsequent charge, the sentences prescribed by South Carolina law become remarkably stringent.

In one of our firm's articles, we discussed this very issue. With any DUI conviction beyond the first, driver license suspension is mandatory, which means that early reinstatement isn't an option. Not only that, but felony charges automatically accompany third and fourth DUI convictions.

Given the way multiple DUI charges are viewed in the eyes of the law, defendants might feel like the deck is stacked against them. Of course, law enforcement officials are going to pursue charges aggressively, but that doesn't mean accused individuals are without options or, more importantly, that conviction is an inevitable outcome. No matter if a person is facing drunk driving charges for the first or third time, he or she is considered innocent until proven otherwise.

A critical component of defending against drunk driving charges is taking all circumstances into account. When a person has is facing DUI charges for the third or fourth time, treatment might prove to be more effective than anything else.

With all of this in mind, launching a defense on behalf of someone who has pre-existing DUI charges is a challenge. However, our firm has experience handling difficult cases -- and with success. The process starts with a careful examination of arrest records and evidence gathered by police officers. From there, a defense can be crafted.
