DUIs and speeding: Reckless behaviors threaten your license

Speeding and DUIs are some of the most common moving violations in the U.S. Both have the potential to threaten your license, especially if you are speeding while intoxicated.

There are different levels of penalties for those who commit these varying degrees of crimes. For example, if you speed 5 mph over the limit, you'll face lower penalties than someone speeding 15 or more mph over the limit. Excessive speeding could even lead to accusations of street racing, which could result in a misdemeanor, the loss of your license and fines.

Combined with a DUI, you could face significant penalties including jail time. The more simultaneous traffic violations, the more reckless you'll appear to the court and prosecution. For example, if you're speeding and racing while intoxicated, you may face fines for each violation, time in jail and additional charges such as reckless driving.

Along with the above serious moving violations, you should remember that refusing a Breathalyzer test may result in the loss of your license immediately. When you accept a license, you're agreeing to take a Breathalyzer test when asked, so failing to do so is a violation as well.

What can you do if you face a DUI charge combined with other violations?

It's important that you try to have the number of charges lowered and to get the types changed to lower charges. For example, if you can get your DUI charge lowered to driving while ability impaired, it may have different penalties. If you can show that you weren't racing despite speeding, then having the racing charge dropped will help, too.

Your attorney will review your case carefully to see which charges they can have changed or eliminated. They'll talk to you about the penalties you face and what you can do to mitigate them. In some cases, alternative sentences may be a possibility, helping you seek alcohol or substance abuse treatment, or other alternatives to traditional sentences.

A single mistake of driving while drunk or violating the speed limit by too much can lead to serious penalties that continue to impact your life far into the future. If you have received a DUI charge or face other moving violations, it's a good idea to look into your legal rights in South Carolina and what you can do to mitigate or eliminate the penalties that you may face in the future.
