Felony DUI charges require action

There may be some drivers in South Carolina who are under the impression that there is only one type of charge for drunk driving, and that the potential consequences are the same across the board. While this type of misunderstanding might be common when dealing with felony DUI charges, it is important to understand the difference. Not only can a felony DUI have harsher consequences, it can also be a more difficult matter to overcome.

So what exactly is a felony DUI? A typical DUI charge is considered a misdemeanor, while extenuating circumstances such as an exceptionally high blood-alcohol content or excessive speed can contribute toward a felony. If a car wreck is caused by a suspected drunk driver, and one or more individuals suffered a serious injury or died, he or she may be dealing with a felony DUI rather than a misdemeanor.

Unfortunately, even relatively subjective measures of intoxication can contribute to a felony. This can include an arresting officer's interpretation of a field sobriety test. In many instances, the field sobriety test in question is taped for further evidence, although the interpretation of its contents is still up to the individual viewer.

We know how stressful it is to be accused of a felony DUI, and the worry that often accompanies these types of charges is completely understandable. Time spent behind bars and steep fines have the potential to completely derail South Carolina drivers' lives, not to mention that a conviction for a DUI can follow individuals to potential future employers or even education opportunities. When it comes to fighting felony DUI charges, we understand how attention to detail and a thorough investigation into the circumstances surrounding your arrest can reveal the whole truth about the situation, and not just the side that the police are presenting.
