Driver faces felony DUI charges in connection with fatal crash

It was before dawn on a recent Saturday when the South Carolina Highway Patrol was called to the scene of an accident. When troopers arrived, it was discovered that an 82-year-old man had suffered fatal injuries and passed away at the scene. Another driver was taken into custody and is now facing felony DUI charges in connection with his death.

The South Carolina Highway Patrol says that the 30-year-old driver was traveling south on State 291. Reports indicate, however, that his vehicle was in the northbound lane at the time. The older driver was in that lane when the two vehicles collided. The southbound driver suffered injuries in the crash that were considered to be minor.

While at the scene, troopers somehow came to the conclusion that the younger driver was impaired at the time of the crash. No report was given as to how that was determined at the scene and whether results of a blood test are available. At last report, the man was denied bond and is being held at the Greenville County Detention Center.

Like anyone else facing felony DUI charges, the driver is entitled to the presumption of innocence. Prosecutors will be required to prove to the court beyond a reasonable doubt that this man is guilty of the crimes with which he was charged. His criminal defense team will have the opportunity to review all of the evidence, along with the statements of any witnesses and officers at the scene. Doing so could provide a viable defense against the charges and the possibility of other alternate resolutions to the case.
